In accordance with Law 34/2002, of 11 July, on Information Society and E-Commerce Services, and specifically with Article 10 thereof, the following Legal Notice is made available to users.

Accessing, browsing, and using the website https://actlegal-spain.com (hereinafter the ‘Website’) implies your tacit and unreserved acceptance of all the provisions of this Legal Notice, being as valid and binding as any written and signed contract.

Its observance and compliance shall be enforceable in respect of any person who accesses, browses, or uses the Website. If you do not agree with the conditions set forth, please refrain from accessing, browsing, or using the Website.

2. PURPOSE

This Legal Notice regulates the access, browsing, and use of the Website, informing users of their rights and obligations in relation to the content displayed therein, the logos and trademarks used, as well as the responsibilities that may arise from their use.

Access to the Website is free of charge.

The main purpose of the Website is to publicise the law firm ACT LEGAL-SPAIN, S.L.P. and all its services.

Notwithstanding the foregoing, ACT LEGAL-SPAIN reserves the right to modify the Website’s presentation, settings, and content as well as this Legal Notice, for which reason users are encouraged to review it regularly. Accessing and/or using the Website after the entry into force of its modifications or changes implies acceptance of them.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

ACT LEGAL-SPAIN is the owner, or where applicable, holds the corresponding licences to the intellectual, industrial, image, or any similar property rights to the Website, as well as to all the content available therein, including but not limited to photos, illustrations, logos, trademarks, graphics, designs, interfaces, or any other information or content contained therein.

Users only hold a non-exclusive right of use, within a strictly personal scope and for the sole purpose of being able to browse the Website in accordance with this Legal Notice.

4. RULES OF WEBSITE USE

4.1 Access or use of the Website for illegal or unauthorised purposes, with or without an economic aim, is prohibited, and therefore users shall be solely liable for the consequences of the same. Specifically, and without limitation, the following is prohibited:

(i) using the Website in any way that could cause damage, interruptions, inefficiencies, or defects in the operation of these or in third-party devices;

(ii) using the Website for the transmission, installation, or publication of any virus, Trojan horse, worm, malicious code, or other harmful or unlawful programs or files;

(iii) using the Website to transmit material for advertising or promotional purposes, including spam, chain emails, or similar, without ACT LEGAL-SPAIN‘s prior express written permission;

(iv) using the Website in any way that constitutes a violation of any rights of ACT LEGAL-SPAIN or third parties;

(v) using the Website to collect personal data from other users;

(vi) using the Website in an illegal manner, against good faith, morality, and/or public order;

(vii) gaining unauthorised access to any section of the Website, to other systems or networks connected thereto, to any ACT LEGAL-SPAIN server, or to the services offered through the Website by means of hacking, password mining, or any other means or method that is illegitimate or established in this Legal Notice;

(viii) carrying out any action that causes the disproportionate or unnecessary saturation of the Website infrastructure, or the systems or networks used or owned by ACT LEGAL-SPAIN, or the systems and networks connected to the Website.

Failure to comply with any of the above obligations by Website users may cause ACT LEGAL-SPAIN to adopt the appropriate measures permitted under law and in the exercise of its legitimate interests.

4.2 All information provided by the user by filling out the forms on the Website for the above or any other purposes must be truthful. For these purposes, the user guarantees the authenticity of all the data they transmit, and they shall keep the information provided to ACT LEGAL-SPAIN up-to-date so that it reflects, at all times, the user’s real situation. In any case, the user shall be solely liable for any false or inaccurate statements made and any damage caused to ACT LEGAL-SPAIN or to third parties due to the information they provide.

5. RESPONSIBILITIES AND GUARANTEES

ACT LEGAL-SPAIN cannot guarantee the reliability, usefulness, or veracity of all the information contained in the Website, nor can it guarantee the usefulness or veracity of the content made available to users through the Website.

Consequently, ACT LEGAL-SPAIN does not guarantee or take responsibility for:

(i) the continuity of the Website content;

(ii) the absence of errors in said content;

(iii) the absence of viruses, Trojan horses, worms, and/or other malicious or technologically harmful components from the Website or the server that hosts it;

(iv) the invulnerability of the Website and/or the impossibility of contravening the security measures adopted therein;

(v) the usefulness or performance of the Website content;

(vi) failures of the Website caused by any type of attack on its servers or those of ACT LEGAL-SPAIN‘s third-party service providers, as well as technical or security failures in the system of any of said providers that prevent the proper functioning of the Website;

(vii) any technical failure of any kind that hinders, delays or prevents the proper functioning of the Website;

(viii) the damages caused, to themselves or to a third party, by any person who violates the conditions, rules, and instructions that ACT LEGAL-SPAIN establishes on the Website or through a breach of the security systems.

ACT LEGAL-SPAIN declares that it has adopted all the necessary measures, within its capabilities and the framework of current technology, to guarantee the Website’s operation and to minimise system errors, both from a technical point of view and in terms of the content published on the Website. 

ACT LEGAL-SPAIN is not responsible for the veracity, integrity, or updating of the information published on the Website from sources unrelated to it, or for that contained on other platforms to which the Website is linked.

ACT LEGAL-SPAIN reserves the right to suspend, modify, restrict, or interrupt, either temporarily or permanently, access, browsing, use, hosting, and/or downloading of the content, and/or use of the Website’s services, with or without prior notification, by users who violate any of the provisions detailed in this Legal Notice, without the possibility of claiming compensation on these grounds.

6. FORCE MAJEURE

Notwithstanding the foregoing, ACT LEGAL-SPAIN shall not be responsible for delays or failures that affect the access, functioning, and operation of the Website, its content and/or services, or for interruptions, suspensions, or malfunctions thereof when they arise from breakdowns caused by any situation of force majeure.

We are not liable for any breach or delay in carrying out any action when it is due to events beyond our reasonable control (‘Force Majeure Situation’).

Force Majeure Situations shall include any act, event, failure to exercise, omission, or accident that is beyond our reasonable control, and among others, the following:

(i) Strikes, lockouts, or other protest measures;

(ii) Civil commotion, riot, invasion, terrorist threat or attack, war (declared or undeclared), or threat or preparations for war;

(iii) Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster;

(iv) Impossibility of using trains, ships, planes, motor transport, or other means of transport, public or private;

(v) Impossibility of using public or private telecommunications systems;

(vi) Acts, decrees, legislation, regulations, or restrictions of any government or public authority.

The aforementioned actions shall be understood to be suspended while the Force Majeure Situation continues, and the term to comply with them shall be extended for a period of time equal to the duration of the Force Majeure Situation. We will use all reasonable means to end the Force Majeure Situation or to find a solution that allows us to fulfil our obligations despite the Force Majeure Situation.

ACT LEGAL-SPAIN will respond to claims or inquiries as soon as possible, and in any case, within a maximum period of one (1) month.

8. CONFIDENTIALITY AND DATA PROTECTION

In accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural 

persons with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC, and Organic Law 3/2018 on personal data protection and guarantee of digital rights, all personal data provided while using the Website shall be treated in accordance with the provisions of the Privacy Policy, which users should read in order to, where applicable, grant their acceptance or consent.

9. SALVATORY CLAUSE

All the clauses or provisions of this Legal Notice must be interpreted independently. In the event that one clause has been declared null by a legal judgement or final arbitration resolution, the remaining clauses shall not be affected. The affected clause or clauses shall be replaced by another or others that preserve the intended effects of this Legal Notice.

10. APPLICABLE LAW AND JURISDICTION

The access and use of the Website shall be governed and interpreted in accordance with Spanish legislation.

In the event of any dispute or discrepancy in the interpretation and/or application of the Legal Notice, the competent Courts shall be those designated by the applicable regulations, and if allowed, all disputes shall be submitted to the Courts of the city of Madrid.
